日中で都市計画優先：Urban Planning Rules in Japan/China

はたしてリーズナブルか？：Is It Reasonable?

上海では「都市計画」が絶対的に優先するらしく、最近承認された上海都市改造計画に従って、ある工業地区が商業地区に指定替えされ、その結果として日本企業10社がその地区から立ち退きを命じられた。しかもこれは計画の第1期なので、最終的には同地区に立地するかなりの数の日本企業が影響を受ける可能性がある（下記の産経のリンク参照）。
都市計画について多少似たことが日本でも起こっており、本日の新聞報道によれば（下記の毎日のリンク参照）、最高裁が昨日「都市計画」を主な理由として、住民の反対にもかかわらず鉄道会社の鉄道高架化を認める判決を下した。これによって、住民が12年間にわたり高架化に反対してきた運動も終わりをつげることになる。
ここで問題は、都市計画がどのように作られ、決定されるかということである。それが透明でリーズナブルなものであり、またそうであるときにのみ、都市計画は絶対的に優先されるべきものとなるであろう。

It seems that "urban planning" rules in Shanghei, where 10 Japanese firms have just been ordered by the city of Shanghei to move out of the present location of the industrial zone which is to be converted into a commercial zone, according to a recently approved urban reform plan. Since this is just the first stage of urban reform in the city, much more Japanese firms located in the same zone could eventually be affected (see the first link above).
Somewhat similarly in Japan, "urban planning" was cited by the Supreme Court yesterday as the main reason to allow a railway company to elevate its railway despite neighboring residents' opposition, according to today's newspaper report (see the second link above). This will put an end to the 12 year old protest by the residents against the railway company's elevation project.
Then the question is how urban planning is formed and finalized. If and only if it is transparent and reasonable, urban planning should be allowed to rule absolutely.
